A seller can list the property for market value and when they get an offer they can apply for a short sale with THEIR lender. They ask to sell the property and either release them from the balance of the mortgage. Once sellers get a contract then they can begin to negotiate with the lender. They can ask to be released from any balance or can negotiate a reduced amount to be paid in installments. Each bank is different to work with however, the lender is not obligated by our real estate "time is of the essence". They can take anywhere from 2-6 months to approve an offer. The seller has to provide quite a bit of documentation for a short sale. The buyer just has to have patience. Many short sales will end in foreclosure. However, from my experience, it can take anywhere from 6 months to 2 years for the bank to actually foreclose and take back the property. These can be great deals and are definitely worth the wait!
